1. Agreement to Terms

By accessing and using this website (the "Site"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with all of these terms, you are expressly prohibited from using the Site and must discontinue use immediately. These terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and PT SINAR SUNDA NUSANTARA (“we,” “us,” or “our”), concerning your access to and use of the Site.

2. User Accounts

To access certain features of the Site, you must register for an account. You agree to provide true, accurate, current, and complete information about yourself as prompted by the Site’s registration form. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

3. Ordering Process and Commercial Terms

• Offer to Purchase: Placing an order through the Site's shopping cart system constitutes an offer by you to purchase the products selected. This offer is not a binding contract.
• Minimum Order Quantity (MOQ): All orders are subject to a Minimum Order Quantity of 18 Metric Tons (MT). The system will not allow checkout for orders below this threshold.
• Order Confirmation: An order is not considered accepted by us until you receive a formal order confirmation from our sales team. We reserve the right to refuse or cancel any order for any reason at our discretion.
• Binding Contract: A legally binding contract for the sale of goods is only formed upon the mutual execution of a formal sales agreement and/or the establishment of an agreed-upon payment instrument, such as a Letter of Credit (L/C) or confirmed Telegraphic Transfer (T/T).

4. Products, Pricing, and Payment

• Product Information: We make every effort to display as accurately as possible the information and specifications of our products. However, we do not warrant that product descriptions, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free.
• Pricing: Prices are quoted in U.S. Dollars (USD) per kilogram (KG) and are subject to change without notice. The final price, including the total for the ordered tonnage and the flat-rate shipping fee of $720.00, will be calculated at checkout.
• Payment: Accepted payment methods include Letter of Credit (L/C), Telegraphic Transfer (T/T), and Cash in Advance (CIA). Specific payment terms will be communicated and finalized by our sales team after an order is placed.

5. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

6. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to systematically retrieve data or other content from the Site to create a collection, compilation, database, or directory without written permission from us.

7. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if we have been advised of the possibility of such damages.

8. Governing Law

These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the Republic of Indonesia applicable to agreements made and to be entirely performed within the Republic of Indonesia, without regard to its conflict of law principles.
